NY Gov Mario Cuomo has signed legislation requiring that Medical Assistance and Private Insurance companies in NY reimburse for Telehealth/Telemedicine starting in January, 2015.

Click here for a link to the approved language.  It includes the following:

"SUBJECT TO THE APPROVAL OF THE DIRECTOR OF THE BUDGET, THE COMMISSIONER SHALL NOT EXCLUDE FROM THE PAYMENT OF MEDICAL ASSISTANCE FUNDS THE PROVISION OF MEDICAL CARE THROUGH TELEMEDICINE SERVICES"

(Prior to 2015) there is now limited Medicaid coverage, but both ends must be in NYS Article 28 clinics/hospitals.

Read here to see what Telehealth services NY Medicaid covers for Article 28 facilities.

Since all NYS Licensed Mental Health Clinics, where the Psychiatrists who accept Medicaid are located, are licensed under NYS Article 30, it essentially cancels out coverage for mental health services.

This has been brought to the Insurance Commissioner's attention but has not been fixed yet.
